Recently Governor Bevin issued an Executive Order regarding the Workers Compensation Nominating Commission (WCNC) which is responsible for screening applicants for Administrative Law Judges (ALJs) for Workers Compensation cases. As you know, ALJs are assigned to resolve workers compensation cases.

Teamsters Local 89 encourages all of our members to go to the polls on Tuesday and exercise their right to vote for pro-worker candidates. Teamsters Local 89, along with many other labor organizations in the area, have researched and interviewed the various candidates for the primary races.

    Today the IBT Carhaul negotiating committee sent out a memorandum to all affected Local Unions giving a brief update about the Carhaul contract. The memorandum states that the negotiating committee and the employers remain apart on most critical economic issues, including pay retroactivity and the appropriate level of wage increases.

    On Monday, March 28th a new five-year agreement was overwhelmingly ratified by members at K&T Switching, with only a single vote against. In the past K&T members have always enjoyed strong contract language on working conditions and rules, but have struggled without pay increases, vacation reductions, and loss of holidays due to turbulence in the automobile industry.

Three weeks of vacation after seven years. Four weeks of vacation after thirteen years. Pay progression removed for all employees. $1.40 per hour wage increase in the first year. $.

    Applications for Local 89 scholarships for sons and daughters of ACTIVE members of the local union are now being accepted. Three scholarships will be awarded to male students and three scholarships will be awarded to female students. Each scholarship is for the sum of $1,000.

    On Saturday, February 13 2016, the membership at Brown Forman overwhelmingly ratified a new five-year agreement by a count of 114 yes to 27 no. Two prior agreements offered by the company were strongly rejected by the members, who felt the company was holding back on them.

    Mechanics and servicemen Teamster members employed by Ryder Truck Rental overwhelmingly ratified a new three-year agreement on Sunday, January 31st of 2016. Among the highlights of the new agreement are substantial pay increases for all three years, including first year raises averaging $2.19 dollars per hour.

    Her grievances were deadlocked by UPS and the IBT state panel system failed her, but Madonna Russell and Teamsters Local 89 still found a way to get justice in a small UPS facility in Campbellsville, Kentucky. A Teamster since 1985, Madonna was an exemplary employee who worked in a small UPS center in Campbellsville, where she served as a steward for seventeen years.

    Members at Atlantic Aviation unanimously approved a new four-year agreement that includes a number of improvements, including a minimum of $1.90 an hour in raises throughout the life of the contract. Additionally, negotiations chair Kevin Evans and his committee were able to prevent any increases in costs for health insurance, which was a major concern for the affected members.

As the deadline for comments approached, the Treasury chose to extend the comment period in order to allow more opinions to be heard. Today is that new deadline.

    The Ohio Teamsters Strike Fund recently honored Teamsters 89 with a certificate marking the 20th anniversary of the Strike Fund, and thanking Local 89 for being a long-time participant.  This fund provides strike benefits for more than 75,000 Teamsters from 37 IBT Local Unions across fourteen different states. Since it went active in 1995, the fund has paid out more than $8.

This new three-year agreement contains many improvements for the affected members including: Increase in holiday pay if working on the holiday.     Recently there has been a rash of employees facing termination at UPS due to failure to completely follow all steps of the disability reporting procedure. The two largest problems at this time are Employees do not have their current address on file with UPS, resulting in them not receiving crucial correspondence from UPS.

    On June 21st of 2015, a thirty-one-year employee with an exemplary record was terminated from American Greetings. Secretary-Treasurer and Business Agent John Bolton handled this case through all steps of the grievance process which eventually led to mediation.

    A Tentative Agreement (TA) was reached on Tuesday evening (December 15th) between the Teamsters Local 89 negotiating committee and IMI in Harrodsburg and Lawrenceburg. Some of the highlights of this new TA are as follows: Wage increases of $.70 cents in the first year, $.55 cents in the second year, and $.40 cents in the third year.

    We are very sorry to report that retired Teamsters 89 member Nelson Kost passed away on Tuesday at the age of 79. Nelson worked for many years as a car hauler at Allied Systems and retired in 1993. He was also a Shriner in the Boaz Masonic Lodge.

    In December of 2014 Congress did an unbelievable disservice to the American people by passing the Multiemployer Pension Reform Act (MPRA). MPRA allows underfunded pensions to slash the benefits for active and already retired members. The Central States Pension Fund, to which 9,000 active and retired members of Teamsters Local 89 belong, is by far the largest of the endangered plans.

    Teamsters Local 89 observers at the Carhaul contract vote count have reported that the NMATA Tentative Agreement has been resoundingly rejected by the membership nationwide. The national numbers that have been reported to Teamsters Local 89 at this time are: 372 YES to 2503 NO, resulting in a rejection by 87% of national Carhaul members.

    Attention all Teamsters Local 89 members, this is a message from President Fred Zuckerman: Avral and I attended the Central States Pension fund meeting yesterday in Chicago. C/S notified us they sent their proposed plan to reduce pensions to the Treasury Dept last Friday. Treasury has up to 225 days to approve the plan and send it out for a vote or reject the plan. Letters were mailed out to all participants on Thursday and should tell you how you will be affected by the proposed changes. Although it becomes complicated with the many different considerations I will briefly outline the changes.

    First reported at the September General Membership Meeting, after several years of talks Teamsters Local 89 has purchased the Grady's building and it's property that sits next to our union hall on Taylor Boulevard. Local 89 took ownership of the building today and will be renovating it for use by the Teamsters 89 Retiree Club.

    At a meeting at the Local 89 union hall on Sunday, September 27th over 200 Carhaul members unanimously agreed to vote against the 2015 NMATA Tentative Agreement. The nearly two hour meeting started at 4PM and was conducted by President Fred Zuckerman and Vice-President Avral Thompson.

    On Saturday, September 26th Local 89 members unanimously ratified a new three year agreement with Kellogs. Included in this new contract are wage increases for all three years, 4% increases each year to the Central State pension fund, and the company paying for all Central States insurance including increases.

The information the IBT has provided to date is inadequate and incomplete. It does not sufficiently explain all the proposed changes, most notably in regard to drastic overhauls to the wage rates.

    Teamsters Local 89 has joined with eight other unions in filing a federal lawsuit against Hardin County for its recent passage of an illegal “right to work” ordinance.  The lawsuit, which was filed earlier today, came after yesterday’s approval of the anti-worker law by the Hardin County Fiscal Court.

    Local 89 has won a major arbitration victory at Transervice (Kroger Warehouse) regarding seniority and “emergency runs” for drivers.  The company was found to have violated the seniority-based process of selection for bid runs resulting from an alleged “emergency”.   In question was the very definition of “emergency”.

    As a result of a very successful four-day strike, Local 89 members who were unlawfully displaced at Ford’s Louisville Assembly Plant by Voith Industrial Services in 2012 are returning to work.  These workers (166 employees on the original LAP seniority board, plus an additional 84 hired by Voith at LAP since 2012) will receive full restoration of seniority, wages and benefits.

    Teamsters at Kapstone Paper in Bowling Green approved a new four-year agreement. Included in the new contract are improved 401k contributions, annual wage increases, shift differential pay, enhanced vacation language and increases in shoe allowances.   There were also improvements in seniority rights related to forced overtime and in maintenance language.

The contract provides for six years of job security, $3.01 in raises over the life of the agreement, and “buybacks” for attendance and standards.
